President Obama announces a new Deferred Action Program – DAPA (Deferred Action for Parental Accountability)

President Obama recently announced a new Deferred Action Program for people who are in the United States without lawful immigration status. This new Program is called DAPA, or Deferred Action for Parental Accountability
If you qualify for this program you may be able to get a work permit, a driver’s license and be shielded from deportation for three (3) years at a time, with the opportunity to reapply.

If you have been in the U.S. without lawful immigration status for at least 5 years and you have a child who is a U.S. citizen or lawful permanent resident, you may be eligible for this new Deferred Action Program.

* There is currently no application process in place for the DAPA applications. Beware of notarios or other individuals who take your money and promise to file your applications now. You can prepare to file, however, the government has provided a 180 day period to implement the new application process.

ELIGIBILITY REQUIREMENTS:

You have, on November 20th, 2014, a son or daughter who is a U.S. citizen or lawful permanent resident; and
You have continuously resided in the U.S. since before January 1st, 2010; and
You are physically present in the U.S. on November 20th, 2014, and at the time of making a request for consideration of deferred action with USCIS; and
You have no lawful immigration status on November 20th, 2014; and
You are not an enforcement priority
You present no other factors that, in the exercise of discretion, makes the grant of deferred action inappropriate.
